realistically it depends on the state but

There is no definitive answer because the test isn’t scientific. It’s for the jury to determine whether or not driving was negligent, reckless or intentional (and their slight variations).

What I would say is that it’s unlikely that a jury wouldn’t see a motorcyclist passing in between cars at 60-70mph as lawful, and if there was an accident it’s likely they would find the motorcyclist partially or fully at fault

i drive so submissively that when i see a fast car coming right behind me on the high way i immediately stop in front of them coz my doe instincts kick in and i freeze up like a doe to let them overtake me since they’re the assertive driver who wants to go fiuuuuuuuuuuuuuuuuu
