realistically it depends on the state but
There is no definitive answer because the test isnât scientific. Itâs for the jury to determine whether or not driving was negligent, reckless or intentional (and their slight variations).
What I would say is that itâs unlikely that a jury wouldnât see a motorcyclist passing in between cars at 60-70mph as lawful, and if there was an accident itâs likely they would find the motorcyclist partially or fully at fault
