It’s genuinely crazy how many convictions are predicated on this sort of thing. People have proven to not actually reliable at identifying people they’ve seen like once ever for not that long. (And also this is a thing that disproportionately harms minorities in the US.) Not saying that you, Ash, are wrong in this instance for what it’s worth. I just worked in a public defender’s office, and tend to think about legal things from the side of the defendant. The bar should be higher for convictions than specious or circumstantial evidence at best and witness identification when there isn’t reasonable grounds for said witness to actually be able to reliably identify the perpetrator.

wow that sounds like a terrible way to do a line-up! wildly worse than standard* procedure!

* contrary to how fiction sometimes depicts it, you’re not supposed to have one line-up of all the guys you think might be guilty, you’re supposed to have a line-up of 1 suspect and a bunch of non-suspects, and to be allowed to say ‘it is not any of those people.’ obviously this is still a very imperfect system but it beats the thing they do in movies (possibly they also do it in real life occasionally but only if they’re incompetent)
