“The prosecution calls for ‘Tally’.” Violetta gives a half-shrug, as Sincred quickly returns to her side.
The bailiff… brings a small piece of paper to the prosecutor’s stand. Violetta reads out: “This witness has written this in custody, infront of security cameras. If need be, the Judge may access this footage to ensure that it was written by the witness.”
She gives Arius a look, and continues “I entered the building after seeing it on fire, and watched Mortia enter into one of the rooms, manic, after I saw her turn the stove top on, and place down a portable heater. We were both then brought out by the police.”
“I would like to submit this piece of paper into evidence.” She hands it to the judge… who then whispers to her and she hands it to you. It says what she stated.
“I would like to question why the witness is unable to be present in court.”
“Witness protection.” Violetta states.
“Yes… it says so right here!” He picks up and nearly flashes the paperwork, before remembering he’s in court and placing his finger on the text instead. “Witness is in protection, and thus, cannot appear in court.”
…How are you supposed to cross-exa-
“Would you like to cross examine the witness, Defense?”
“Yes, actually. I heard there were two sources of the fire; the stove and the portable heater. Yet according to this statement, the heater had yet to explode, and stove was turned on after the witness entered the house… The house which they claimed to have already been on fire before they entered it.”
“The windows weren’t blocked in any way, and a curtain infront of the stove was taken down. You can’t claim that the witness was unable to see from the outside!”
“Perhaps. But the witness never stated that they saw the defendant turning on the stove before entering the house. Instead they only claimed that the defendant entered another room after turning on the stove.”
“Based on the sole statement given, it looks to me that the testimony itself is a giant contradiction.”
“Does it matter whether or not they included if they were inside or outside the house?”
“You have no evidence in it’s relevance.”
“Well if they were not inside the house, then how could we rely on the credibility of their statement?”
“And if they were inside the house, then their statement contradicted itself because they stated the fire had already started before the stove was turned on.”
“The windows. It is possible they saw the defendant set the fire traps from the inside, then ran inside to catch them in the room.”
“I would like to have the witness state that, and not the prosecution. I do not recall the witness giving permission to let the prosecution to speak on their behalf.”
“…”
The bailiff murmurs something to the judge, and steps out of the room.
“Well then. It appears there witness is unable to testify for the moment. I would like to call in the defendant in the meantime to testify about their actions during this incident.”
“The prosecution agrees.”
Mortia takes the stand.
“Well then, Ms. Mouse. I would like to ask you this again: What were you doing at the time of the incident? I doubt you were taking a walk near your former partner’s home, six streets away from your own home.”
