I did some digging to understand why they didn’t do as you said and keep a consistent meaning that includes trans women, because that would make complete sense.
A point they make is that a trans man would have zero protection for maternity and paternity protections under the Act, which the UKSC allege supports their point that it is referring specifically to biological women, as they believe parliament intended for trans men to be protected under maternity and paternity legislation too. (para 178 & para 182)
The politicians absolutely knew all of this while they were writing it btw. Which is basically what the UKSC have said in passing as well

Okay, let’s say we had a law about automobiles and it had sections that referred to sedans and others than referred to trucks. If there was a section that was applicable for vehicles with 4 wheel drive, but they used to word “truck” even though there are sedans with 4WD the section would otherwise apply to. Lawmakers knew those sedans existed, and intended for the section to apply to those vehicles as well, but used the word “truck” because that’s what people commonly understand to have 4WD. This ruling is like saying that any vehicle that has 4WD must be a truck and cannot be a truck without 4WD under the law because of that one section. So what would otherwise be trucks are now classified as sedans because they rolled off the factory floor with 4WD, and things that were otherwise trucks before and, in all other ways that matter besides have 4WD, are still trucks, must be classified as sedans. This ruling would actually go further and is still trying to include trucks without 4WD as trucks because like they hypothetically could have or should have had 4WD in the courts view, and that’s all that matters for the purposes of being of truck. This is why I think it’s stupid and did not have to be this way because it’s actually fine to have one section refer to “trucks with 4WD” actually mean “automobiles with 4WD generally” instead of basing the entire classification of trucks around one God damn feature that not all of them even have.
